  • your protection covers you and any driver of your car plus any passengers in your vehicle and any other vehicle in which you or your family are travelling.

You should print a copy for your file and keep a copy in all vehicles for which you are responsible at all times.

Details of your cover

 

The service:

 

1. Meaning of words

Wherever the following words and phrases (shown here in BOLD) appear in this document they will always have these meanings:

Person or You/Your: The person who has the benefit of this Service together with his/her spouse or common law or civil partner and children and any passenger who is in or on the Vehicle or the Bicycle with Your permission, or such person's personal representative(s) or estate;

Vehicle: A vehicle (including a motorbike) covered under Private Motor Insurance driven by or under the control of The Person;

Bicycle: A bicycle being ridden by You or the Person;

Geographical Limits: Any country within the United Kingdom;

Incident: A Road Traffic Accident involving the Vehicle or Bicycle causing a Personal Injury within the Geographical Limits and where a claim can be brought within the courts of England and Wales, Scotland or Northern Ireland during the Period of Service;

Multi-Party Action: A case where a number of claimants are pursuing the same or a similar action against one opponent or one set of opponents alleging the same cause of action;

Period of Service: A twelve month period from the commencement date;

Service Limit: for services offered under Section 2.1 (i), £100,000; for services under Section 2.1 (ii), £200; for services under Section 2.2, £200; for services under Section 2.3, £150; for each said sums, in total, in connection with any one event giving rise to a cost and inclusive of Value Added Tax;

Private Motor Insurance: motor insurance issued to cover the Vehicle to comply with Road Traffic Act requirements;

Personal Injury: the impairment of Your physical or mental condition following an accidental bodily injury caused solely and directly by accidental, external, visible and violent means for which You claim compensation including the death of any person on whose behalf You are pursuing a claim as a personal representative;

Reasonable prospects of success: The likelihood that the amounts You are awarded (and can reasonably expect to obtain) will exceed the cost of obtaining them, together with any amounts awarded against You;

Rehabilitation Costs: the treatment, physiotherapy, healing, remedy or cure identified by the suitably qualified doctor, medical consultant or other expert whom We appoint, carried out within the United Kingdom, with Our prior approval and the adoption of which We consider shall have a tangible and beneficial impact on Your recovery from the Personal Injury following a Road Traffic Accident;

Road Traffic Accident: An accident between the Vehicle or the Bicycle and another motorised vehicle causing You Personal Injury as a result more of the negligence of another person than of You;

Solicitor: the solicitor or other suitably qualified person We appoint to pursue Your claim;

Test Case: A case being pursued by one or more claimants against one opponent or one set of opponents on behalf of and/or as an example case for other claimants intending to pursue or pursuing an action which is fundamentally similar to or the same as the test case;

We, Our or Us: Quality Law Limited and/or the Law Answers network.

 

2. What is provided by the service

2.1 Legal expenses

If it is advisable to do so We will ensure that a Solicitor appointed by Us will put in place at their own expense a policy of insurance to cover the pursuit of a civil claim for damages including instituting legal proceedings in connection with claims arising from: (i) Your Personal Injury or death; and (ii) damage to the Vehicle or the Bicycle; and in either such case as a direct result of an Incident, whilst the Vehicle is being driven by, or in the custody or control of, You or a named driver under The Private Motor Insurance or in the case of the Bicycle is under the custody and control of you or a Person, and which is not recoverable under any more specific contract of insurance covering the Vehicle;

2.2 Rehabilitation costs

Rehabilitation Costs related to a Personal Injury claim following a Road Traffic Accident (as defined above):

following Personal Injury, We will reimburse You (or another party who, with Our prior agreement, has paid or incurred liability) for Rehabilitation Costs incurred with Our prior approval;

2.3 Recovery costs

If the Vehicle is immobilised or rendered unroadworthy as the result of an Incident, We will arrange and pay for the transportation of the Vehicle to the nearest suitable repairer.

 

3. Service conditions

3.1 You must tell Us in writing as soon as reasonably possible about any incident which could result in a claim being made under this protection.

3.2 You must:-

  • give proper instructions to Us, and provide Us with information at Your expense;
  • not do anything to prejudice Your case;
  • help Us to minimise the cost of any service provided;
  • advise us of any legal expenses insurance which would cover an action for which We provide this service.

3.3 We shall have complete control over the legal proceedings although You do not have to accept the Solicitor nominated by Us If You are unable to agree with Us on a suitable solicitor you may appoint your own Solicitor provided they confirm in writing to us that suitable insurance is in place to cover all costs and expenses of providing this service;

3.4 Unless You are acting with Our prior written authority, We will not be bound by any promise or undertaking given by You to the Solicitor.
