Accident involving driver on International Licence who had been here more than a year: are they insured and what charges might follow?

If you have been involved in an accident with another vehicle and currently have an international driving licence with a provisional UK licence, what would be the legal outcome if you thought you can drive with international licence for 1 year after obtaining provisonal, but been 1 year 1 month and 13 days in the country? I have a valid MOT and insurance

You can drive for one year on an international licence and it does not necessarily have to be the first year when you arrive. If you can show you did not commence driving on the international licence on arrival then your licence is valid and you have committed no offence. Furthermore your insurance will be valid.

I would add that detailed checks may not be made. If the police charge you with not driving in accordance with your licence then you need to come back to us.

As regards the insurance position, if you were at fault then you may be reliant on showing that you were indeed permitted to drive the car on your International Driving Permit. If you were not at fault then whether your permit is in date is largely irrelevant to the insurance position as your claim is against the other party's insurer and not your own.
