Can another person who is insured for my car collect it after it was impounded for being driven by someone without insurance?
I own a car but let someone else drive it in another town over 50 miles away. Someone other than him drove the car and was stopped and the car impounded as he was not named on the insurance. The police have his name and address. The car is registered and insured in my name. I cannot get to the town to claim back the car but have passed the log book to the person I willingly lent the car to, and who is fully comprehensively insured to drive my car. Can he take this documentation to the police station to get the release papers in my absence? I called the station and they said it was down to their discretion.
If he is insured for the vehicle then he can reclaim the vehicle but he will have to pay the recovery fees and the storage costs. These will not be recoverable.
He should also be avoid any discussion as to how the other person came to be driving the vehicle as if it is found that they were driving it with his permission it is possible he could be charged with assisting an insurance offence which brings 6-8 points - the same as for the uninsured driver.
