Car damaged in hotel car park by delivery vehicle: can I claim against the hotel?
My car was damaged on the car park of the Big Blue hotel in Blackpool. The person responsible did not stop. The car park has a sign up saying that cars are parked at the owners risk and the company cannot be held responsible for damage, theft from any vehicle. We believe this was caused by a delivery vehicle dropping its tail lift. Can I claim from the hotel for the damage?
It will be hard to make a claim against the hotel but you should check if CCTV is available showing the incident which may reveal either a vehicle number or a company name whereupon you would be able to bring an action against them. If CCTV evidence is unavailable you might ask them for details of the deliveries they received on that day, although this will get you little further in proving the detail of the case without an admission.
