My mother's partner has died leaving his one third of the home to his grandchildren. He promised that my mother could remain in the bungalow for as long as she wanted but this is not specified in the Will. What position does this put my mother in? What options are available?
We would need to check the wording of the Will but, in the absence of any life interest or right for your mother to reside in the property, then she is, to some extent, at the mercy of the children. They could force the sale of the property in order to realise their inheritance but, if the matter went to Court, they may have some sympathy for her position. If your mother owned the property with her partner then she would be entitled to remain there.
