Same job two different pay scales: can I get equal pay?
I have been working in my company now for a year. Everyone in my department is doing the exact same job, although we are split into two grades. I am in the lower paid grade and I know the guy who sits beside me (who is on the higher paid grade) is getting paid at least £5000 a year more than me. Is this even legal? Do I have grounds to take my company to court or can I demand equal pay?
Thank you for your question.
If the pay differential can be related to age race sex or disability it is potentially indirect discrimination which is illegal.
Otherwise although the grading system may seem unfair it is not illegal. Your best bet in pursuing this matter is to discuss with your manager and if you do not get a satisfactory reply put in a grievance using the Company Grievance Policy
