What can be done if a clean break Order is ignored?

What can be done if a clean break Order is ignored? My wife has began divorce proceedings against me. I have read much advice from you here about the value of a clean break Order, which I want to pursue. I have also read about clean break Orders being ignored. As a clean break Order requires both parties to agree, how can I ensure that no future claims can be made against me if my wife simply ignores the Order?

If a clean break is not agreed and you take the view that it is the appropriate way forward then you can seek to have your case settled by the Court.  If the Judge, having heard all the details in the case, considers a clean break is the appropriate way forward then he/she can order that the matrimonial assets are distributed on a clean break basis.

It will not then be possible for either party to seek to vary the Order afterwards except in certain rare cases.
