I was caught doing 86mph in a 50mph limit by radar gun. What is the best I can hope for? by Maria Mason — last modified 2008-11-20 19:57
I was caught doing 86mph in a 50mph limit by radar gun. I thought it was a 70mph limit because it was a dual carriageway. The officer said I would get summonsed to Court. There was no warning signs of any speed cameras. I travel a 90 mile round trip to get to work and back, haven't been caught for speeding for over 10 years and have no points on my licence. What is the best I can hope for?
Is a faulty speedometer a valid reason to contest a speeding ticket? by Maria Mason — last modified 2008-11-18 11:41
I have just received a NIP for travelling at 36mph in a 30mph zone. The following day I went through the same camera and made sure I was only doing 29mph and was flashed again. It looks like the speedometer in my car is faulty, but only having had the car MOT'd the previous week I presumed that there was no problem with my car and that it was legal to drive. Is the faulty speedo a valid reason to contest the first and possibly the second SP30? If so, what evidence do I need to produce? If I do contest and fail what the likely costs going to be compared to the actual fine?
Is there a maximum time between being caught for speeding by a camera and being notified that a prosecution will go ahead? by Maria Mason — last modified 2008-11-12 15:03
Is there a maximum time between being caught for speeding by a camera and being notified that a prosecution will go ahead?
My friend drove my car after I had a few drinks and was caught speeding. He's not insured for my car. If I name him as the driver will I be prosecuted? What's the best thing to do? by Maria Mason — last modified 2008-11-10 19:18
My friend offered to drive my car after I had a few drinks. He was caught speeding with a speed camera. He's not on my insurance policy. If I give his name as the driver of the vehicle will I be prosecuted for him not being on my insurance policy? What's the best thing to do?
I have been caught allegedly speeding. Is there any law saying the police have to have clocked me for a certain amount of time or can they just use what the radar gun says? by Maria Mason — last modified 2008-11-05 10:45
I was driving on the motorway two months ago and there was a police car parked at the side of the motorway. At the time I didn't realise how fast I was going, but when I saw them I slowed right down and passed them doing 70mph. The police then followed me and pulled me over and said they clocked me at 101mph. I have now received a Summons to Court. Is there any law saying they have to have clocked me for a certain amount of time or can they just use what the radar gun says?
Do mobile speed cameras need to be signposted in advance? by Maria Mason — last modified 2008-11-04 19:27
Speed cameras are always (to my knowledge) signposted in advance. Do mobile cameras need to be signposted too? If so, does that mean an unsignposted mobile unit cannot legally charge someone with speeding?
Regarding the new driver rules can you tell me when the six points within a two year period is applicable? Is it up to when the offence took place or when the points are awarded? by Maria Mason — last modified 2008-11-04 11:27
Regarding the new driver rules can you tell me when the six points within a two year period is applicable? Is it up to when the offence took place or when the points are awarded? My son got two speeding tickets (camera) in two days on the same stretch of road. He was within a couple of months of having had his licence for two years but by the time he gets the points it will be over two years. He is self employed and needs to be able to drive.
My friend is visiting the UK and was stopped for doing 102-104mph on the motorway. He was told he would have to go to Court, why did he not just get a fixed penalty. He is due to leave the UK soon, what should he do? by Maria Mason — last modified 2008-10-23 13:10
My friend is visiting the UK and driving on his Indian licence. He was stopped by the police for doing 102-104mph for about a mile on the motorway. He was told that he will receive a summons to Court and he was then allowed to continue his journey. Why did he not just receive a fixed penalty for speeding, why does he have to attend Court? My friend is very anxious about this as he will be leaving the UK within a couple of weeks and is very keen to resolve this issue before then.
How much is the fine if I am caught speeding whilst driving with a Malaysian driving licence? by Maria Mason — last modified 2008-10-22 15:35
How much is the fine if I am caught speeding whilst driving with a Malaysian driving licence? I believe it is £60 with a British driving licence.
I have had my licence re-issued after a six month ban under the totting up process. Do any previous endorsements still count or do I start again with no points? by Maria Mason — last modified 2008-10-22 13:38
I have recently had my licence re-issued after a six month ban under the totting up process. Do any previous endorsements that are not time expired still count in the totting up or do I start again with no points? I had three points for speeding in 2006.
I was caught speeding but have only just received the summons 6 months and 24 days later! Is this legal? If I plead not guilty what documents must the police produce? by Maria Mason — last modified 2008-10-22 11:34
I was caught by a mobile speed camera doing 59mph in a 50mph limit but I have only just received the summons 6 months and 24 days later! The police did issue a summons 4 months and 2 weeks after the offence but sent it to the wrong address. Is this legal? I am going to plead not guilty as I don’t believe I was speeding. What documents must the police provide to help me with my defence?
I received two NIPs for the same offence. Different reference numbers but same time, speed and date. Are these valid? by Maria Mason — last modified 2008-10-21 18:28
I received two Notices of Intention to Prosecute for the same speeding offence. The Notices had different reference numbers but the same time, speed and date. I sent them both back to the department not filled in. I sent them by recorded delivery and with a letter but have had no contact as yet. Is the offence still valid or can I fight it in Court having received two Notices for same offence?
I passed my driving test less than two years ago and since then have received two lots of three points. I have heard nothing from the DVLA for over ten months and don't know if I have been disqualified or not. What should I do? by Maria Mason — last modified 2008-10-17 13:41
I passed my driving test less than two years ago. I then received three points for speeding and then another three points, also for speeding. I know that if you get six points you have to take the test again but it has been over ten months now and I have not heard anything about disqualification etc. What can I do as obviously my life is on hold? I don't want to inform the DVLA as they might not know ... if you know what I mean.
My partner was driving my car and got caught speeding. He already has nine points. What would happen if I say I was driving? by Maria Mason — last modified 2008-10-15 13:33
My partner was driving my car and got caught doing 38mph in a 30mph limit. He already has nine points on his licence but I have a clean licence. If I say I was driving so that he doesn't lose his licence, because his job involves driving, what will happen if it was found that I had lied to save his neck? I am relucant to do it but we can't afford to lose his money.
My friend was selling his car and let a potential buyer test drive it who then got caught speeding. My friend does not have contact details for the potential buyer. What should he do? by Maria Mason — last modified 2008-10-08 19:22
My friend was recently selling his car and let a potential buyer test drive it who then got caught speeding. My friend is now looking at three points and a £60 fine but he doesn't have contact details for the potential buyer.
I have received a NIP for speeding but on that date I and my car were elsewhere. I believe my car may have been cloned. How should I proceed? by Maria Mason — last modified 2008-10-08 18:15
I have received a Notice of Intended Prosecution for speeding with the registration of my car on it. However, the offence was committed on a date/time and location when I and my car were elsewhere. My conclusion is that either my car has been cloned or the registration has been used illegally. Can you please advise as to how I ought to proceed i.e. should I return the form stating this and ask for photo evidence? How can I alert the DVLA that this may be the case?
I only have a provisional licence and was caught speeding. I have to produce my papers at the police station. What will happen to me when they find out I only have a provisional licence? by Maria Mason — last modified 2008-10-08 11:52
I just hold a provisional licence and the other day I took my car for a spin and got caught speeding doing 48mph in a 30mph zone. I got an on the spot fine of £60 and 3 points but I didn't tell the officer that I only have a provisional licence. I have to go to the police station in the next seven days to show my licence, MOT and insurance certificate. What will happen to me when they find out that I just hold a provisional licence?
I have received a NIP for doing 36mph in a 30mph zone. I don't believe I was doing this speed and have a faulty speedometer. I am disabled and cannot afford to pay the fine. Can I contest this? by Maria Mason — last modified 2008-10-07 13:17
I was caught by a speed camera doing 36mph in a 30mph zone. I now have to either pay £60.00 and have points on my licence or attend a speed awareness workshop for three hours (which I can't do as I have to care for my disabled daughter) and still pay £60.00. I am on disability and the reason I was "speeding" at 6mph over was because my daughter had called me to say she was having a panic attack and needed me at home. I also have a speedometer that I'm not sure is accurate, sometimes it moves very little even when I'm changing gear so there is a certain amount of guesswork about the speed I'm doing. I rarely go faster than 25mph anyway and the clock did show just a tiny bit over 30mph ... certainly not 6 though. I cannot work due to my disability so money is very tight and I can't afford to pay the fine at the moment. Can I contest this NIP? All that money and hassle because of a "estimated" 6mph ... which I don't believe due to my speedometer. What will happen if I contest it?
As a new driver are you automatically disqualified after getting six points or can you receive six points and still be allowed to drive? by Maria Mason — last modified 2008-10-05 18:29
I think I just drove past a speed camera exceeding the speed limit. Because of reasons that left me shaken I was speeding and this was the first time I've sped since I received my first three points, however I suppose this doesn't really matter in the eyes of the law. My question is, as a new driver are you automatically disqualified after getting six points or can you receive six points and still be allowed to drive?
Can I transfer my driving without insurance offence to my father who assured me the car was insured and I was a named driver? by Maria Mason — last modified 2008-10-02 10:50
Can I transfer my driving without insurance offence to my father who assured me the car was insured and I was a named driver? I have been charged with using my mobile phone while driving my mother’s car as a named driver, but as it turned out the car was not insured as my father who normally attends to this had overlooked the renewal date of the policy. Can I plead not guilty as this was not my fault? My father had assured me that the car was insured. If I am convicted of this then it is likely that I could reach 12 penalty points as I already have 3 points for speeding in June 2006 and I will get another 3 points for using a mobile phone and then an additional 6 points for the no insurance offence.
